Big East sues West Virginia

The Big East sued West Virginia on Friday, in its attempt to force the school to follow conference bylaws and the required 27-month waiting period before joining the Big 12.

The lawsuit charges a breach of contract, and seeks an order requiring the school to adhere to Big East bylaws, along with damages. West Virginia filed its own suit against the Big East this week, also charging breach of contract.

Here is the statement from commissioner John Marinatto on the Big East suit:

“Today’s legal action underscores the Big East conference’s stated position that it will vigorously pursue the enforcement of its rights and West Virginia University’s obligations under the conference’s Bylaws which West Virginia formally agreed to and helped construct.”

According to the Big East lawsuit, the conference bylaws "specifically provide that the conference shall be entitled to seek and obtain injunctive relief, including but not limited to an injunction, requiring the Departing Member to comply with the withdrawal procedures and obligations set forth in the bylaws."
